EXPLANATION:
The property owner, Fenway Development, Inc., is requesting approval of a preliminary site evaluation (PSE) on 32.88 acres located between SH 114 and Sam School Rd. The PSE includes 55 single family residential lots and 12 open space lots.
The PSE is commonly referred to as a "preliminary plat" in other municipalities. The Westlake Code of Ordinances defines a PSE as follows:
"A preliminary site evaluation is required for all major subdivisions prior to the construction of improvements. A preliminary site evaluation shall be labeled "preliminary site evaluation." A preliminary site evaluation is not a preliminary or final plat. It is a development tool for the benefit of the landowner and the town to allow the town and landowner to work together cooperatively. The time limits applicable to plats do not apply to a preliminary site evaluation. Any reference to a "preliminary plat" in the Westlake ordinances shall be understood to mean preliminary site evaluation."
Upon approval of the PSE, the next steps include submission of the civil construction plans and the final plat.
CURRENT CONDITIONS AND ZONING:
The property is currently undeveloped and includes and abandoned gas drilling pad site, which has been abandoned per State and Town requirements. The property is zoned PD10. The PD10 zoning was approved by Ordinance 982 on October 9, 2023. The PSE complies with the approved zoning including the approved concept/development plan.
STAFF RECOMMENDATION:
The PSE complies with applicable Town regulations including Ordinance 982. Staff recommends approval as presented.
