BACKGROUND:

On July 15 the Town Council unanimously passed the  Town of Westlake, Town Council Member (Board of Trustee), Governance and Ethics Policy changes that were presented.  At that time the Mayor and several other Council members requested that the Town Manager work with our Town Attorney to add consequences to violations of the policy. 

DISCUSSION:

Local Government Code Section 22.077 states that upon a finding of incompetency, corruption, misconduct, or malfeasance in office a municipal officer may be removed from his or her office by a majority vote of the governing body.  Municipal Officer in this instance may be the Mayor, a Council Member, or any municipal officer appointed by the Council (governing body). 

FISCAL IMPACT:

Removal of a Mayor or Council member could require the expense of an election. 

STAFF RECOMMENDATION:

Staff has no recommendation as this is a policy issue to be decided upon by the Council.
